Terms of Service
These Terms govern your use of Pathly, a service operated by Pathly (“Pathly”, “we”, “us”) that checks websites’ lead paths (contact forms, booking widgets, calls to action) with automated browser sessions and alerts you when they break. By creating an account or using the service you agree to these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use Pathly.
1. Accounts and organizations
- You must give accurate information and keep your password secret. You are responsible for activity under your account.
- Work in Pathly belongs to an organization. Its owners control its members, plan and billing, and are responsible for what members do in it.
- Pathly is a business service. You must be at least 18 and able to enter a contract for your organization.
2. Websites you may monitor
You may add only websites that you own or are authorized by their owner to monitor. In particular:
- Observe mode loads pages and checks that lead paths are present and working without submitting anything. You must still have the site owner’s permission.
- Test mode fills in and submits forms with the test data you provide. It is available only after you prove control of the domain (DNS record or meta tag). You are responsible for making sure test submissions are expected by the site owner and do not reach real people, trigger charges, or pollute CRM or analytics data.
- You must not use Pathly to load-test, scrape, or disrupt any website, to bypass CAPTCHAs or other access controls, to submit content to sites you are not authorized to test, or for anything unlawful.
We may pause checks or suspend an account that we reasonably believe breaks these rules or harms a website, Pathly, or other customers.
3. Plans, limits and billing
- Each plan includes limits on websites, monitored lead paths, team members and check frequency, shown on the plan page. The Free plan is free; paid plans are billed monthly in advance.
- Payments are processed by our reseller and merchant of record, Lemon Squeezy, which also handles sales tax and VAT and appears on your statement. Its own terms apply to the purchase.
- Subscriptions renew automatically until cancelled. You can cancel at any time from the billing portal; the plan stays active until the end of the period already paid for. Refunds follow our Refund and Cancellation Policy.
- If a renewal payment fails, monitoring continues while payment is retried. If it still fails, the organization moves to the Free plan. When an organization moves to a smaller plan, check frequency is reduced and checks beyond the plan’s limits are paused; nothing is deleted.
- We may change prices with at least 30 days’ notice by email. A change applies from your next billing period after the notice period, and you may cancel before it applies.
4. Your data
You keep all rights to the data you put into Pathly, including lead path definitions and test data, and to the results we collect for you (screenshots, step results, network and console logs). You grant us the rights needed to run the service for you. Our Privacy Policy explains how we handle personal data. Do not put sensitive personal data (for example health or payment card data) into test data.
5. Availability and alerts
We work to keep Pathly running and checks on schedule, but checks can be delayed or missed, for example during maintenance, outages of our providers, or when a website blocks automated browsers. Pathly helps you find problems sooner; it does not guarantee that every failure is detected or that every alert is delivered. Do not rely on it as your only safeguard for critical systems.
6. Browser extension
The optional Chrome extension records lead paths on pages you choose and sends them to your organization. It acts only when you use it, and you can revoke its access from Settings at any time.
7. Intellectual property
Pathly, its software and its branding belong to Pathly. These Terms give you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Do not copy, resell, or reverse engineer the service, or use it to build a competing product.
8. Disclaimers
Except as these Terms expressly state, Pathly is provided “as is” and “as available”, without warranties of any kind, including fitness for a particular purpose and non-infringement, to the fullest extent the law allows.
9. Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, leads or data, even if advised they were possible. Our total liability for any claim relating to Pathly is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Indemnity
You will defend and indemnify us against third-party claims arising from websites you monitor without authorization, from test submissions you configure, or from your breach of these Terms.
11. Ending your use
You can stop using Pathly and cancel your subscription at any time. We may end or suspend your access for a material breach of these Terms, or end the service with at least 30 days’ notice, in which case we will refund any prepaid fees for the period after it ends. On request we will delete your organization’s data, as described in the Privacy Policy.
12. Changes to these Terms
We may update these Terms. For material changes we will give at least 14 days’ notice by email or in the app. Continuing to use Pathly after a change takes effect means you accept it.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which the operator is established, and its courts have exclusive jurisdiction, except where mandatory law gives you the right to bring a claim elsewhere.
